Terms of Service

The contract, in plain English.

Effective: January 1, 2026. Operator: Be Xuan Thanh, Việt Trì, Phú Thọ, Vietnam.

1. Acceptance

By creating an account or using the Chosen Voice AI platform ("Service") you accept these Terms. You must be at least 16 (or the age of majority where you live). If you sign up on behalf of an organisation, you confirm you can bind that organisation to these Terms.

We may update these Terms. For material changes you'll get at least 30 days' notice by email or an in-product banner. Continued use after the effective date counts as acceptance.

2. Your account

Keep your credentials private. You're responsible for activity under your account. If you suspect unauthorised access, write to support@chosenvoiceai.com immediately. We may suspend accounts that share credentials, breach these Terms, or appear compromised.

3. Subscriptions, credits & refunds

Chosen Voice AI runs on credits. Free, Starter, Creator, Pro, Scale, Business and Enterprise plans grant a monthly credit allowance plus optional add-on packs. Subscriptions auto-renew unless cancelled; cancellation stops future renewals but keeps your access until the end of the current billing period.

Refunds are governed by our Refund Policy — 14 days, with specific rules for plans, packs, and supporter contributions.

4. Your content & our licence

You keep ownership of scripts, prompts, audio samples, images, and other content you submit ("User Content"). To operate the Service you grant Be Xuan Thanh a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, copy, modify, transmit, display, and process User Content as needed to run, secure, and improve the Service.

We do not use your scripts, voice clones, or generated outputs to train public AI models. Deleting content terminates the licence for new uses; residual copies in backups or logs may persist briefly before purging.

Generated outputs (audio, images, dubs) are yours to use commercially within the rights granted by your plan. Some third-party providers (ElevenLabs, OpenAI, Fal.ai) impose additional terms on outputs from their models — those apply downstream and are your responsibility to comply with.

5. Voice cloning — mandatory consent

Voice cloning carries real responsibility. Submitting audio for cloning means you accept our Voice Cloning Consent Policy in full. Violations may lead to immediate termination and personal civil or criminal liability.

6. Acceptable use

You agree to our Acceptable Use Policy. Prohibited: impersonation, harassment, fraud, scraping, reverse engineering, and reselling the Service without a written agreement.

7. Intellectual property

Chosen Voice AI, the Chosen Voice AI logo, the Be Xuan Thanh name, and related trademarks, service marks, and proprietary technology belong to Be Xuan Thanh. Don't use them in your business name, domain, email signature, or product naming without prior written consent.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED — MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY ARISING FROM COURSE OF DEALING. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BE XUAN THANH IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

10. Indemnification

You agree to defend, indemnify, and hold harmless Be Xuan Thanh, its representatives, employees, and contractors from claims, damages, or expenses (including reasonable attorney's fees) arising out of your use of the Service, your User Content, or any breach of these Terms — especially claims arising from voice cloning without proper consent.

11. Termination

We may suspend or terminate your account for breach of these Terms, fraud, or where continued service would expose us to legal risk. You may terminate at any time from the dashboard. Sections 4 (licence), 5 (cloning consent), 9 (liability), 10 (indemnification), and 12 (governing law) survive termination.

12. Governing law & disputes

These Terms are governed by the laws of the Socialist Republic of Vietnam, ignoring conflict-of-law rules. Disputes are resolved in the competent courts located in Việt Trì, Phú Thọ, Vietnam, and you consent to personal jurisdiction there.

13. Miscellaneous

If a clause is unenforceable, the rest stays in effect. Our failure to enforce a right is not a waiver. You can't assign these Terms; we may assign them to a successor. These Terms are the entire agreement between you and Be Xuan Thanh regarding the Service.
